This initiative, if passed, will make arbitration a choice, not a condition precedent to receiving healthcare from HMO's like Kaiser Permanente. Your support of this initiative will help bring justice back into managed healthcare, something that has been lacking for far too long. What we didn't understand, until it happened to us, is that the mandatory binding arbitration system takes away each members constitutional right to due process. Arbitrators can make errors of law yet their decision is final with no chance of appeal.
